We ask you to follow these Geekdom Guidelines to ensure the best possible experience for everyone.
Geekdom Terms and Conditions
Your membership with Geekdom is subject to these Terms and Conditions.
Certain word used below have special meanings:
“Application” means the online membership application, desk application, or similar form submitted by you to the Manger that states your member fees and membership benefits.
“Geekdom” means the collaborative co-working space and related programs and services that the Manager makes available to you as part of your membership.
“Guidelines” means the Geekdom Guidelines posted at geekdom.com/guidelines.pdf as they may be amended by the Manager from time-to-time.
“Manager” means Geekdom, LC, a Texas limited liability company.
“Member Agreement” or “Agreement” means the Application, these Terms and Conditions, the Guidelines, and any other document incorporated by reference in any of them.
“You” and “your”, in upper- or lower-case mean the person (individual or entity) that signs or otherwise submits an Application for Geekdom to the Manager.
In the event you have a legal claim against any of the Geekdom Personnel, you agree that the maximum total amount of money you can recover from any or all of them cannot exceed the amount of fees you have paid during the twelve months prior to the date the claim arose, unless the legal claim is based on intentional misconduct or is for personal injury or death resulting from Geekdom Personnel’s negligence, recklessness or intentional misconduct. In addition, you agree that in no event are you entitled to recover any lost revenue, lost profits, damages for lost data, or any indirect or consequential loss or damages or any kind.
You acknowledge that the Manager has set its fees and entered into the Member Agreement in reliance on the limitations of remedies and liability stated in this Agreement, and that these limitations reflect an agreed allocation of risk between you and the Manager. The limitations stated in this Section shall apply to any liability arising from any cause of action whatsoever, whether in contract, tort, commercial code, strict liability or otherwise, even if a limited remedy fails of its essential purpose. If these limitations as written are not permitted by applicable law, they shall apply to the extent permitted by applicable law.
This Agreement is the complete and exclusive agreement between the parties regarding its subject matter and supersedes and replaces in its entirety any prior or contemporaneous agreement or understanding regarding the subject matter of this Agreement, written or oral.
Geekdom cares about your privacy and is committed to protect the privacy and confidentiality of personal data we collect when you visit our website. This policy explains our privacy practices for www.geekdom.com and its associated websites (collectively, the “Website”) and the services provided by Geekdom, LC (“Geekdom,” “us,” or “we”).
Personal information we gather is for internal use only and we will not release this information to anyone outside Geekdom (except to third party service providers to Geekdom who perform functions on our behalf, but in such event personal information will only be shared to the extent reasonably necessary to perform their functions and they will not be authorized to use it for any other function), unless you have consented to such disclosure.
If we are under a duty to disclose or share your personal data in order to comply with any legal obligation, we may disclose your information to a relevant authority. This may include exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction. In particular, we may release the information we collect to third parties when we believe it is appropriate to comply with the law, to enforce our legal rights, to protect the rights and safety of others, or to assist with industry efforts to control fraud, spam or other undesirable conduct.
Active Collection of Information
Personal information may be collected in a number of ways when you visit the Website. We may collect certain information that you voluntarily provide to us which may contain personal information. For example, we may collect your name, email address, user name, and telephone number when you register, become a member, or contact us by e-mail. If your personal information changes, you may correct or update your information by visiting the member portal at: https://member.geekdom.com. If you wish to cancel your membership, you can do so by sending an email to email@example.com and requesting cancellation.
Passive Collection of Information
When you visit the Website, some information may be automatically collected. For example, it is standard for your Web browser to automatically send information to every Web site you visit including ours. Such information includes your computer’s Internet Protocol (”IP”) address, access times, browser type and language, and referring Web site addresses. We may also collect information about your usage and activity on the Website.
When you visit our Website, our server logs your IP address, the time and duration of your visit, and the time and duration of the pages on our Website you view. If you arrive at our Website by clicking a paid advertisement (including a paid search engine result) or a link in an email, then we will capture information that tracks your visit from that link. If you arrive at our Website by clicking a non-paid source, such as link in a non-paid search engine result or an unsponsored link on another website, we may capture information that tracks your visit from that source, to the extent we are able to do so. We may also capture information about your computer system, such as your browser type and operating system.
Links to Third Party Websites
We will not intentionally collect or maintain, and do not want you to provide, any information regarding your medical or health condition, race or ethnic origin, political opinions, religious or philosophical beliefs or other sensitive information.
Children’s Online Privacy Protection
Our services are not designed for or directed to children under the age of 13, and we will not intentionally collect or maintain information about anyone under the age of 13.
We use your personal information to send information about Geekdom products and services and to get in touch with you when necessary. We also use the information we collect to improve the content of the Website and to prevent or detect fraud or abuses of our Website and to enable third parties to carry out technical, logistical or other functions on our behalf.
We use web visit information to measure interest in and develop our web pages and marketing plans, customize the content you view on your web visits based on your activity on past visits, and administer our Website.
We use the visitors’ IP address to help diagnose problems with our servers, and to administer our Websites.
When you sign up for membership or otherwise submit your email address to us, we will use your email address to send you internal communications from Geekdom, Website updates, or informational and service-related communications. If you do not wish to receive email communications about our services, you can opt-out of these communications by clicking “opt-out” at the bottom of the email, contacting us at firstname.lastname@example.org, or writing to us at Geekdom, LC, Attn: Membership Managers, 110 E Houston St, 7th Floor, San Antonio, Texas 78205, to have your name removed from our distribution lists.
Geekdom has implemented and follows industry standard measures to protect against unauthorized access to and unlawful interception or processing of personal information. If you use a password on the Website, you are responsible for keeping it confidential. Do not share it with any other person. If you believe your password has been misused, please notify us immediately. Unfortunately, no data transmission over the Internet is 100% secure. While we strive to protect your personal information, we cannot ensure or warranty the security of any such personal information.
We may disclose your personal information when required by law or in the good-faith belief that such action is necessary in order to conform to the edicts of the law or comply with legal process served on Geekdom. As such, we cannot ensure that your personal information will not be disclosed to third parties. For example, we may be legally obligated to disclose information to the government or third parties under certain circumstances, or third parties may circumvent our security measures to unlawfully intercept or access transmissions or private communications.
