Geekdom Terms and Conditions
Geekdom, LC, a Texas limited liability company (“we,” “us,” or “Manager”), provides and manages a collaborative co-working space located at 110 E. Houston Street, San Antonio, Texas 78205 (“Geekdom”). When we accept you for membership, you will be allowed to use the Geekdom space and participate in events and programs we offer subject to the following terms and conditions (the “Terms”), your application for membership, and any other document incorporated by reference or later issued by us to clarify or supplement these Terms or your rights as a Geekdom member (collectively with the Terms and Application, we’ll call these documents the “Agreement”).
The Agreement is legally binding. For that reason, it’s a good idea for you to read these Terms before you use Geekdom. They will give you a sense of who we are, what we expect from you, and what you can expect from us. We’ve tried to write them in plain English and make them as straightforward as possible. However, sometimes the law requires us to say things using certain words or in a specific way, such as conspicuous all-cap text. The short version is this: We don’t take advantage of people, and we ask in return that you not take advantage of us. If you don’t agree to the Terms, you may not use Geekdom.

OTHER THAN AS EXPRESSLY SET OUT IN THIS AGREEMENT, WE DO NOT MAKE ANY SPECIFIC PROMISES ABOUT THE SERVICES. THE SERVICES ARE PROVIDED “AS IS”, “AS AVAILABLE” AND WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, AND ANY WARRANTIES IMPLIED BY ANY COURSE OF PERFORMANCE OR USAGE OF TRADE, ALL OF WHICH ARE EXPRESSLY DISCLAIMED. WE, AND OUR DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, PARTNERS, AND CONTENT PROVIDERS, DO NOT WARRANT THAT: (A) THE SERVICES WILL BE SECURE OR AVAILABLE AT ANY PARTICULAR TIME OR LOCATION; (B) ANY DEFECTS OR ERRORS WILL BE CORRECTED; (C) ANY CONTENT OR SOFTWARE AVAILABLE AT OR THROUGH THE SERVICES IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR (D) THE RESULTS OF USING THE SERVICES WILL MEET YOUR REQUIREMENTS. YOUR USE OF THE SERVICES IS SOLELY AT YOUR OWN RISK.
In the event you have a legal claim against us, you agree that the maximum total amount of money you can recover cannot exceed the amount of fees you have paid during the twelve months prior to the date the claim arose, unless the legal claim is based on intentional misconduct or is for personal injury or death resulting from our negligence, recklessness or intentional misconduct. In addition, you agree that in no event are you entitled to recover any lost revenue, lost profits, damages for lost data, or any indirect or consequential loss or damages or any kind. You acknowledge that we have set our fees and entered into the Agreement in reliance on the limitations of remedies and liability stated in this Agreement, and that these limitations reflect an agreed allocation of risk between you and us. The limitations stated in this Section shall apply to any liability arising from any cause of action whatsoever, whether in contract, tort, commercial code, strict liability or otherwise, even if a limited remedy fails of its essential purpose. If these limitations as written are not permitted by applicable law, they shall apply to the extent permitted by applicable law.

This Privacy Policy applies to all information (including personal information) collected through the Website. If we are under a duty to disclose or share your personal data in order to comply with any legal obligation, we may disclose your information to a relevant authority. This may include exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction. In particular, we may release the information we collect to third parties when we believe it is appropriate to comply with the law, to enforce our legal rights, to protect the rights and safety of others, or to assist with industry efforts to control fraud, spam or other undesirable conduct.
Active Collection of Information
Personal information may be collected in a number of ways when you visit the Website. We may collect certain information that you voluntarily provide to us which may contain personal information. For example, we may collect your name, email address, user name, and telephone number when you register, become a member, or contact us by e-mail. If your personal information changes, you may correct or update your information by visiting the member portal at: https://member.geekdom.com. If you wish to cancel your membership, you can do so by sending an email to mm@geekdom.com and requesting cancellation.
Passive Collection of Information
When you visit the Website, some information may be automatically collected. Such information includes your computer’s Internet Protocol (”IP”) address, access times, browser type and language, and referring Web site addresses. When you visit our Website, our server logs your IP address, the time and duration of your visit, and the time and duration of the pages on our Website you view. If you arrive at our Website by clicking a paid advertisement (including a paid search engine result) or a link in an email, then we will capture information that tracks your visit from that link. We do link the information we store in cookies to your personal information entered into the Website. This link is only used internally for Website usage tracking and for re-marketing Geekdom’s product and services to you. Our services are not designed for or directed to children under the age of 13, and we will not intentionally collect or maintain information about anyone under the age of 13.
We use your personal information to send information about Geekdom products and services and to get in touch with you when necessary. We also use the information we collect to improve the content of the Website and to prevent or detect fraud or abuses of our Website and to enable third parties to carry out technical, logistical or other functions on our behalf.
We use web visit information to measure interest in and develop our web pages and marketing plans, customize the content you view on your web visits based on your activity on past visits, and administer our Website.
We use the visitors’ IP address to help diagnose problems with our servers, and to administer our Websites.
We use cookies to help us recognize visitors as unique visitors (just a number) when they return to our Website. Geekdom has implemented and follows industry standard measures to protect against unauthorized access to and unlawful interception or processing of personal information. If you use a password on the Website, you are responsible for keeping it confidential. Do not share it with any other person. If you believe your password has been misused, please notify us immediately. Unfortunately, no data transmission over the Internet is 100% secure. While we strive to protect your personal information, we cannot ensure or warranty the security of any such personal information.
We may update this policy from time to time. If we believe that the changes are material, we’ll let you know by doing one (or more) of the following: (1) posting the changes on the Website, (2) sending you an email or message about the changes, or (3) posting an update to Slack and/or the Member Portal. That way you can decide whether you want to continue using the Website. Changes will be effective immediately upon posting. You are responsible for reviewing and becoming familiar with any changes. Your use of the Website following the changes constitutes your acceptance of the updated Privacy Policy.
We may disclose your personal information when required by law or in the good-faith belief that such action is necessary in order to conform to the edicts of the law or comply with legal process served on Geekdom. As such, we cannot ensure that your personal information will not be disclosed to third parties. For example, we may be legally obligated to disclose information to the government or third parties under certain circumstances, or third parties may circumvent our security measures to unlawfully intercept or access transmissions or private communications.
